Can I sue UKBA for the delay in ILR processing ?
Hi,
I know I am not from this country. But I have contributed a lot in the form of taxes and NI in the past 6 years. I have applied for ILR SET(O) 3rd November 2012. It's been around 9 months, still my application is in processing.
I can understand there are many applications, but UKBA simply replied to one of my letter through local MP saying that " We have no enough trained personnel in UKBA, hence it's taking time ". As many of you might know, it's not only my problem. So many people are facing the problem.
What I expect is UKBA need to complete application processing within reasonable timelines and can give their decision (weather YES or NO) ?
Every time they are simply answering "still in processing". Keeping passport this many months and pending decision for 9 months creating mental depression and distress.
Can I sue UKBA on any grounds ?
Note : Please give appropriate answers if you can , do not use offending and insulting language.

The answer to your question is this.
The UKBA needs to check everything about you to see if you do qualify for ILR. So you will have to wait.
Can I sue UKBA on any grounds ? NO. A no one will take your case. 2nd you would be wasting your time and money, and third if you did you can forget getting ILR and it will take longer.
All you can do is wait.

Good luck with that. I don't think you have a toe to stand on. A student visa is a non-immigrant visa, therefore nobody owes you a good job. Immigration isn't a right, so there is no obligation on the side of UKBA to help you to get it done as long as they keep within the law. It's also not their job to be your financial counselor or make sure you renew your visas in a timely manner. If you want to lose more money you pay a lawyer for a lawsuit.

too harsh comments here ! UKBA charge fortune to processes the applications. and they must give quick and responsible decision within selected period. if not they should inform before apply. Its life changing decision

Gee sure sue them THAT always works out well when the PLACE you want/ have to deal with is sued THAT makes them so much more eager to ensure YOUR shyt is done in a timely fashion.
And you have paid taxes for LESS time than my dog has been alive so excuse me if that does not carry much weight to the average brit.
Plus it took close to 2 YEARS for my paperwork to be complete for the USA but I am slightly more educated enough to KNOW that suing them would NOT be wise, worth it or productive.
