Wizard's Chess vs Battle Chess?

I think most of us have seen or read a Harry Potter movie an know what Wizard's Chess is: A life size chessboard where pieces move and attack other pieces according to the game.

But for all the genius J.K.Rowling has, chess pieces attacking other pieces is not original. There was a PC chess game called Battle Chess in the 90's that did that exact thing.

Now, she has sued people that have used Harry Potter without her consent. Shouldn't she be sued for the exact same thing? She changed the name, but the idea is the very same. Or maybe she truly didn't know about it, but nevertheless, it already existed.

Please note that I'm not against her or the "Harry Potter everything". I simply want to know if a writer is allowed to do that kind of thing.

Update:

David might be right, Battle Chess could be even from another previous source like a film, but he didn't tell us which one. It'll be interesting to know, but that's not the point. The question is whether it is legal to use that concept in such a similar way, almost exactly.

    Battle Chess was not an original idea either. Not only was the idea of anthropomorphic pieces well known, do you remember how the knights battled in Battle Chess? That was stolen from a film.
