Border crossing with child...?

My husband and I are separated. I have been to court for custody and my case is uncontested. (My final court date is not until December. I have no papers until then saying I have full custody.) My parents live in the US and they want us to come for a visit (end of October). I have not heard nor seen my ex in one month and 5 days, no idea where he disappeared to..no contact. I know crossing the border (we are flying out of Buffalo)you need a consent from the other parents, saying its ok to take the child, etc. I get the point of it. We don't want people taking children when they shouldn't be. But if I have no clue where he is...how am I suppose to get that paper...

I have her birth certificate..the long form, saying I am the mother. I have her passport. I am going to go to the courthouse tomorrow to ask question regarding this but I wonder if anyone has been thru this or has some opinion.....thanks.

Unfortunately my parents cant come...travelling, health, etc. I think asking questions on here just confuses me more. I should just be asking from the proper authorities on the issue. Oh well, gave it a go...thought some reassurance would let me sleep tonight but I guess not. lol.

    Technically, you do have to have permission of the other parent. But actually, during holiday weekends (thanksgiving, etc) the border guards are facing huge crowds and lineups and frequently just skim through. If you have a passport for your daughter, that would probably get you through. That said, I have to point out that you could get a conscientious guard who is going to ask for that letter of permission. It's like a coin toss - do you want to take a chance?

    It takes both parents' consent to get a passport for the child. Since no border patrol agent will ask to see the child's birth certificate or your divorce decree, all you have to tell 'em that you were never married and that the child doesn't have a father. It's a lie, against the law, but unless your husband presses charges against you, you'll get away with it.

    I will deny that ever told you that.

    You can ask for temporary orders granting you full custody. There is also a form you can fill out.

    You'll be asked to submit Form DS-3053 stating why the non-applying parent/guardian's consent cannot be obtained.
