Is what sterling's gf did illegal? Recording a conversation with him and making it public?

which law did she break?

I see cons saying that there was some loss of "liberty" here?

looks to me that she just took her liberty to record a conversation and release it to the public and Sterling wasn't very good about paying attention to the fact that someone may be taking that liberty...

Update:

hmm... after looking it up apparently in 11 states you have to have all parties consent to being taped... and cali is one of those states...

but also, apparently he did consent, according to her? lol...

"The curveball here is that she claims he did consent. Supposedly, she has more than 100 hours of audio of him rambling about God knows what, all of which was done with his approval because, she says … he had trouble remembering things and used the tapes as memory-fresheners. "

In the state of California, and in several other states, the consent of both parties is required for recording a phone conversation, which means that the consent of both parties is required to publish it too, since you can't record it without their consent.

If the conversation was recorded without his consent, this law was broken in California

It depends on the law where the recording was made, but I have a feeling that it was not legal.

She probably did it in California, so its laws would apply.

She claims now that she was his "archivist" and had his permission to tape every conversation with him. It is unclear whether he was banging her or not.

the law varies from state to state..in California BOTH parties must know they're being taped..fortunately for HER, nobody is pursuing Sterling for arrest!..were they to DO so then the tape would become a law enforcement issue!

Usually laws regarding recording a conversation only apply to phones, but it may be applied to a private conversation as well. Laws vary by state, most states are "one party consent" which means that you can do it without the knowledge/consent of the other party, but California is a 2 party consent state.

a student recorded the bullies who beat his *** on a daily basis. Turned the recording over to the principle, and has promptly been arrested and charged with making illegal recordings. While he gets punished, the bullies go scott free.

There is some debate abut who made the recordings and who actually, released them.

California requires that all parties on a call being recorded be notified that a recording is being made. If both parties on the call were in California, yes, she broke the law. She doesn't have the "liberty" to illegally record a phone call.

Did he consent to the conversation being made public? I doubt it.
