Can I have my child's last name changed to my new husband's last name without an adoption taking place?x?

Update:

Child was born out of wedlock and has my maiden name. Birth father is not listed on birth certificate, but paternity was established and he pays child support. Now that I'm married, I would like my child to have my new married name as well. Can this be done legally without my husband adopting my child??

    Yes, you can give your child whatever surname you want and change their surname whenever you want. You can even make one up. If you are not and have never been married to the father then he doesn't legally need to agree, but out of good will, it would be best if you do consult him first.

    Your child may legally use whatever last name he or she wants without having to have a legal name change. You can enroll your child in school for instance using your new husbands last name without there being any legal problem.

    Your child's father would have to consent to the name change. If he does, then you can change it through legal channels.

    If he doesn't, you can't change the name.

    No. Bio father has to give permission first if he still has rights. You have to have a good reason for changing it in order for the courts to grant it as well.

    In my state, this can only be done with the consent of both biological parents, unless one of them no longer has parental rights.
