Because the 1903 Cuban-American treaty states that we can have GITMO for as long we want. If you mean the prison itself, then that's a different story. The people detained at GITMO are unlawful combatants, which is not recognized as rights under the Geneva Conventions, meaning we could do whatever we want with them. What Cuba done is far worse than GITMO, they silence people who opposes their policies and have denied access to the internet.

When we say we want human rights in Cuba, we mean that we want them to stop putting innocent people in prison. We don't object when Cuba puts murderers in prison.
The people we keep in Gitmo are not innocent. So our position is consistent.

The United States leases Guantanamo Bay under the US Cuba Agreement of 1903. I suspect they are a few decades behind with the rent.
The United States Government keeps people imprisoned at Guantanamo Bay without trial and without war being declared in violation of international law. Since the agreement maintains that Cuba maintains sovereignty over the base, it is effectively outside of the jurisdiction of American Courts. The USA is a democracy and it is up to the American people to decide whether they want the country run by international criminals.

The American government does not think there are human rights abuses there. I think Cuba should negotiate on removing the U.S. naval base entirely before opening Cuba up for business.
