You apply for a patent by submitting a specification for your invention, with drawings, forms, fees, for examination by your country's patent office. Because patent laws and regulations are complicated and unforgiving, most people find it necessary to hire a registered patent attorney or agent to draft and make the filings and to move the application through the process for two or three years.

A general rule of thumb would be to budget $10,000 USD for your first patent, although it may cost substantially more if it is a complicated and extended prosecution. It will also cost more if you want to obtain patent protections by filing and pursuing patents in other countries, rather than just one country.

You are not required to do ANY preliminary searching, but you would be wasting your time and money if you were to file an application for something that was the "same" or equivalent to what is already patented or being sold by others.
