It is never illegal for a minor to have sex with an adult. What is illegal is an adult having sex with a minor. The difference between these two is who gets in trouble. Unless the adult did not give consent, the minor will ALWAYS be considered the "victim", and victims do not get arrested.
So even if the 16 year old starts it (as in "hitting on" the 40 year old, the 40 year old is under absolutely no obligation to carry through with the act, and is allowed to just say "No" to the 16 year old.
Of course, this is all assuming that the age of consent is higher than 16 in that jurisdiction. Many are at 16 years old. so a 40 year old having sex with a 16 year old would be legal (if the 16 year old consents).
