    Defense of Your Home: Georgia's Castle Law

    From state rep. Kevin Levitas: At the recent community meeting regarding the home invasion in our area, a few attendees asked about but did not receive answers regarding what rights homeowners have to defend themselves on their own property. For this reason, I have set out below Georgia's "Castle Law." However, residents should, if at all possible, first immediately dial 911 before taking any action themselves if they believe that someone is prowling on their property or is about to attempt to break into their home. Because the police are both specially trained and properly equipped to deal with such situations, residents are more likely to remain out of harm's way if the police can respond promptly. The extent of the homeowners' rights to defend their "habitat" is spelled out in Section 16-3-23 of the Georgia Code (known as the "Official Code of Georgia Annotated" or "O.C.G.A."). That code section provides that: A person is justified in threatening or using force against another when and to the extent that he or she reasonably believes that such threat or force is necessary to prevent or terminate such other's unlawful entry into or attack upon a habitation; however, such person is justified in the use of force which is intended or likely to cause death or great bodily harm only if: (1) The entry is made or attempted in a violent and tumultuous manner and he or she reasonably believes that the entry is attempted or made for the purpose of assaulting or offering personal violence to any person dwelling or being therein and that such force is necessary to prevent the assault or offer of personal violence; (2) That force is used against another person who is not a member of the family or household and who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence and the person using such force knew or had reason to believe that an unlawful and forcible entry occurred; or (3) The person using such force reasonably believes that the entry is made or attempted for the purpose of committing a felony therein and that such force is necessary to prevent the commission of the felony. In addition to the above rights, a person acting in compliance with Section 16-3-23: "has no duty to retreat and has the right to stand his or her ground and use force as provided in . . . Code section[ 16-3-23], including deadly force." O.C.G.A. Section 16-3-23.1. As used in Code Sections 16-3-23 , "the term 'habitation' means any dwelling, motor vehicle, or place of business." O.C.G.A. Section 16-3- 24.1. Remember, you and your family are more likely to remain safe if the police can respond quickly, and you let them handle the situation. Never hesitate to contact the police if you see any suspicious activity in your neighborhood, such as cars that or people who do not seem to belong there. Contact Information for Rep.     Maybe. If you are *in* the vehicle the law referenced by Lizzy would certainly apply. If the vehicle was parked on the curb and you were inside your house then it would not apply.
