Parking Lot In Walmart Help ?
I was leaving Walmart on a rainy day. After loading groceries my passenger and I got into my car. After checking all mirrors and looking back I proceeded to move my car back out the space. Suddenly a car from the opposite side of my parking row and I struck. I was completely yet almost out and the other car was almost out not completely and the woman jumped out the car. And pushed a car. She said she stopped her car to move a buggy. I believe she was in the parking space but not fully in the space and notice a cart that would potientially prevent her from moving her car all the way in. By that time I'm heading out and she's backed her car out same time and ran into me. When you are driving down a aisle you have the right away and parked cars have to watch out. She tried to do a combo which was park reverse and move a cart as if she still has the right away and ended up hitting me. Once you are in a spot whether your incompletely or half way in if ur idea is to move something and in order to do so you have to reverse you no longer have the right away because now reversing puts you in jeopardy To hitting people and cars like me? The question is whose at fault even tho it's 1 sided . I am just wondering .

If this goes through insurance, it will end up as a fifty-fifty. That means each vehicle is 50% responsible for the accident.
Insurance companies don't "fight it out" over parking lot accidents with minor damage, because it's simply not worth it. It costs over $15,000 just to prepare for a trial, and the costs really add up once the trial begins. They're not going to do that for an accident that caused $1500 in damage to each vehicle, they only do it when big money is on the line.
In a case like this, each insurance company will accept 50% liability on behalf of their clients and be done with it. They won't even ask Walmart or anyone else for copies of camera footage, they'll just agree to a 50-50 and close the file.

The insurance companies will deal with this. They have a standard operation procedure for these type of things.
A lot of times they just pay for their customer, the only thing with that is you will have to pay your deductible and it may go as a non-fault accident. If she is at fault, then you own no deductible and you don't have a claim on your record.
If she pullled in, then you backed out into a clear area, and were say 80% out then she backed into the side of your car or a rear quarter panel, you may have a case that you were out of your spot.
But if you both hit rear bumpers, probably 50/50.
As side note after like 5 of these close calls, I always park like 3 spaces past the last car in the row.
I think people get in the car and check the the cell phone and back out at the same time.

HUH, once again. IF, driving in an aisle, you do have the right of way, (but) in a parking lot, you MUST expect that at "any" time vehicles will back up/in into a spot, so you must be aware and looking out for any car that may hit you.
You gave so much garbage about what she did and you getting groceries etc, but, all the insurance companies do, is take both you and the other drivers statements of how this accident happened, (where) are the damages to your car, (where) the damages are to her car. Was either you still in a spot, halfway, 3/4 in/out, or if any of you was in the aisle when hit, then insurance will determine who is at fault.
But, as a general rule, insurance will find BOTH of you at fault, either 50/50 or 70/30 etc, since like stated above, parking lots are accidents waiting to happen, and you have to expect that drivers don't pay attention, or try to avoid an accident "if possible".
Wait till insurance makes the call.

You both are at fault, as you both were obviously not watching behind your cars as you backed out. You must keep constant lookout all around the back of your vehicles, and in each direction left/right for oncoming traffic. I think the parking situation could stand improvements. This is why I like to pull through, if I can, to the space on the other end of my space, so I can pull straight out when I leave.

You will probably both be found at fault since you were both reversing.
FYI: Cars driving down the aisle don't have the right away. They have the right OF way.

Too many jumbled details for anyone to properly discern, Scott. Your insurance provider, and that of the other motorist, will determine fault. That's their job.

Our opinion of who is at fault doesn't count. Only your insurance company's opinion actually counts.

I would split the responsibility 50/50. but the decision is neither mine nor yours to make. The 2 insurance companies will decide.

This will be a 50/50. You were BOTH moving and you BOTH hit another vehicle.

The person backing will likely be found liable.......BUT.....ONLY the involved insurance companies can, do and will determine fault (liability. They will notify you who was found liable soon. Nobody here knows for certain who will be found liable.
