Do the Native Nations (the Indians) in the US now have CONSTITUTIONAL (Federal) rights to land, or is that decided on state level?

In other words, will one of the Nations have more rights (own tax rights or own legislation such as legalised gambling for example) in West Virginia than in Minesota, or is it all regulated on a federal level?

    It's federal.  Their rights to their land are via various acts, etc, not the Constitution.
