She would not be arrested or charged because she didn't commit a crime. A few states have tried this, and it's been found unconstitutional.

Heavy drinking does not kill a fetus - which, by the way, is what "it" is until "it" is delivered from the mother's body. I have no idea what would happen IF anything you fantasize about were true. I'm not a sitting Judge. Is that your specific issue? Your mother drank to excess when she was pregnant, and you are paying a steep price for that drinking? It would explain any number of your theories. This makes every bit as much sense as your "can a woman who doesn't have sex get pregnant" question.

I mean what's the difference between this and abortion. Once they legalize abortions. It's a slippery slop.
