  • Crimianl case dismiss with prejudice?

    It's a long story. A friend of mine is managing a duplex, a new tenants suppose to move in prior she gave him a deposit for $200.00 the day came the lady does not want to move she wants her money back. He said to her, I do not have it with me, I need to call the owner please come tomorrow. When he gets into his car he was attacked she stood between the door and him and started ho hit him with her fist. She broke his glass, damaged his car the amount close to $2000.00 besides leaving big marks on him.

    He tried to defend himself by pushing her to get away from her. The guy leaves he is in shock 2 hours later he goes to the police its in Phx, AZ. The lady who attacked him file an assault charge against him she plays the victim after attacking him. He is a man 6"2 220LB. The police take her a Victim and he is the bad guy even due she was the aggressor." she has al little scratch on her cheek according to the police report. Now she hired a lawyer to sue the owner of the place for her medical bill. What about his damage who is responsible her car insurance, his car insurance, the owner home insurance? The home insurance does not want to pay his share but willing to give her some so she will go away. The case went to criminal court but it was dismiss without prejudice. i assume it can be re file. Any suggestion what to do, who will pay for his damage? The lady is CRAZY!!!

  • Lease to purchase house in Phoenix, AZ-as a seller?

    I own a house that has 3 units for sell in Phoenix AZ, it was on and off market, the RE sucks there. I have two families renting it they are not able to purchase it.

    My realtor had suggested if I would offer the option Lease to Purchase I can move the house fast, I want to sell it. As a seller what are advantage and disadvantage for me, the price is$ 230,000 how much down payment can I ask and how much if I collect $1400 can go through the credit mortgage payment benefiting the buyer?

    What if the buyer fall behind with his payment-is this easy to evict. It’s very easy to evict a renter, but is these tenants consider as a buyer or tenants? Thanks

  • Hysterectomy side effects- what about Uterine Fibroid Embolization?

    I have a bleeding over 3 weeks, my uterine is large and I have Fibroid. My OBGY wants me to have Hysterectomy, I am getting Provera 10mg since last Sunday, and I had increased the doze to 20 mg.

    I am afraid of the surgery, I have heard about Uterine Fibroid Embolization which is non surgical treatment.

    My OBGY does not believe in that and refused to help me. I went to my primary care and got refer to see another OBGY for a second opinion.

    Ladies please tell me about your own experience which procedure did you have.

    What are the side effects of Hysterectomy, mood swing gaining extra weight? How long it takes to heal and be away from work? Thanks,

  • Repair gate broken slats who is responsible.?

    I own a house in Glendale, AZ; I have a property management company that they are OK, not 100% sometime they do mistakes. My tenant is a single mother with 2 kids she has been living in the house for 2 years. In the beginning she used to call the property management for small things like changing a light ball, trimming the bushes, I told them that I will not pay for those expenses she is not living in a hotel that she can have a " room service" I had paid for the entire bill at that time but gave them a warring. About 4 months ago someone had tried to break into the house and broke the window glass, I was billed for that and it was about $160.00, I got upset and I told the property management that I can't be responsible for her belonging she should get an insurance. I was willing to pay only 1/2 the bill-$80.00. Now I got a letter from HOA the yard gate is broken the slats need to be repaired. What do u think is responsible?I am wondering if they are careless. Her kids are teenager.

  • Its listed a single family home but it a duplex with a in laws quarters too (3 units)?

    I have purchased a house in Phoenix, AZ. When I had purchased it they were two families living in that. This house is a duplex I bought it like that. Each has 2 bedrooms and 1 bath the garage was converted to a room. I bought in 2005 "as it is". I had paid cash (took a home equity loan) I had tried to sell it over a year the buyers were not qualified. It was appraised for 245,000. Now I am renting it there only one meter to all and tenants are sharing the bills. The zoning for this house is a single family home, next to that there is an apartment complex, on the same street there is a big house with one acre and the owner divided it he sells the house with some land and the rest he sells the land. Am I going to be in trouble with the city because my house is a duplex? but I bought it like that. There is in laws quarters has small kitchen no stove and we are renting it- is it illegal? I am afraid to start it with a city and get myself in trouble. Any suggestions??? Some feedback?

  • Cure Period Notice?

    Can some one explain me? I am selling a house in AZ; buyers are having some problem with their loan according to my RE agent. He had emailed me a form to be sign by me " Cure Period Notice”.

    The documents suppose to be completed on 1-8-2007 and I extended that in the contract for 7 extra business days. What am my rights as a seller, how long can I wait until the buyer with come with the approved loan?

    I can't wait forever-is there a limit time? Its says on the form that after 3 days to failure to complete it will become a breach of contract. Thanks,

    Please let me know, if you had scabies and what did you use? I went to my doctor and got prescription cream but he still very itchy I had looked up on the internet to buy something else maybe more aggressive but there are 4-5 products before I spend any money on something that may not help please let me know which one did you try and did help you.   • Buyer want me the seller pay closing cost in AZ.-Will mortgage rates go up?

    I am in process of selling my house in AZ. Is it common in AZ that the seller have to pay 100% closing cost for the buyer? It seem like I have to pay someone to buy my house.

    I am trying to sell a house in Phoenix near downtown it’s a duplex. It was a fixer upper I had put lots of work and money and I am trying to sell it. I have a realtor so I am not trying to sell by myself. The only people who want to buy it are not qualified or have bad credit. I had a buyer who wanted me to pay all his closing fees and $15, 000.00 carryback for 3 years- I thought it was a bad deal for me. Please give me you feedback about carryback and if the prices will go up or stay the same. I had tried to rent it out but tenants want to have a long term and I want to have from month to month.   • I am owner who need feedback about section 8-Phoenix, AZ?

    I own a house in Phoenix, AZ the house is for sale. Its acutely a duplex it has been on the market for 5.5 months and its still not sold, the market is soft and the buyers are coming with unheard demands. So I decided to rent the house in the mean time and the house will be on the market for sale. I want to have a month to month rental agreement with 30 days notice. I got some people who applied buy they are section 8, I called the city and I was told that I need to sign one year. Please let me know if you had experience bad or good with tenants with section 8.     My cat is a female 8 yo and she normally will go out a few times a day, since yesterday she is asleep she had used her litter box and her eyes look OK, do you think she is sick? She ate very little-we had some painting done outside the house and she did not like to be outside during the day.

    The state is AZ; I have a court judgment against someone and this person refuse to pay me. I had sent a constable to her property and I also place a lien against her house. I got a letter from her attorney saying that I can’t place a lien on someone homestead –this is the only house she owns and I should remove the lien its illegal and I can be fine $5,000. I talked with the constable his answer was he thinks that the lawyer tries to blow some air but he is not attorney. I had looked up and I had found this link;
