    My spouse is 87 years of age and has been covered by John Hancock LTC insurance since the age of 81. Her policy has a 90 day elimination period (benefits begin to payout 90 days after an M.D. certifies she can no longer perform 2 of the 6 Activities of Daily Living. She was hospitalized for four days recently for slow heart rate and doctors reviewed her heart medicine, added a new medication, discontinued 3 others. A physical therapist, provided by Medicare, discovered she was not taking the correct medicine, and double the proper dose. She is mobility impaired due to severe forward curvature of her spine upward from the middle of her back.

    We're under increased financial strain due to the fact that we lost $1,050/mo in rental income.

    The benefits payout is only be for 12 months (based on the Daily rate times 365 days). Obviously her benefits will last longer if she receives in-home care rather than skilled nursing care. Obviously, to stop paying the premiums at this point means we forfeit the accumulated cash benefits.

    Her policy has a 90 day elimination period. I realize we must wait 90 days from her date of eligibility before we receive the first dollar of benefits. During that 90 day period do I have to demonstrate to the LTC insurance company that I incurred ongoing expenses for her care?

    I have been using Windows operating systems and Quicken for years. I just bought an Apple Macbook Pro and I am trying to decide whether I should load QuickBooks on the Mac Book or on the laptop computer where I currently have Quicken loaded. A tax expert is willing to get me set up my business on Quickbooks on whichever computer I load the software. I own a business that sells products and involves an inventory and a second business that sells products and services but does not involve keeping track of an inventory. Do I need QuickBooks? Should I get QuickBooks for Windows or Mac?

  • Which is better? 'Sleep' or 'Hibernate' on a Windows computer?

    Now that I know the difference between the two terms, I am unsure which is better for my laptop running Windows 7. I seldom close down applications and save documents when I'm ready to move on to something else. When I come back to my laptop that has been sleeping (hibernating?) it seems overly sluggish, and most of the time I wind up just holding the On-Off button until the light go out, then reboot, which works but seems very non-graceful workaround.

    I want to buy a HD tv and a Roku device that will work together to give me the best streaming HD picture possible. I have been reading about 720p, 1080i, and understand native resolution. The whole point of this purchase is to watch Glenn Beck (gbtv.com) while walking on my treadmill but (short of contacting customer service at gbtv.com which I have done) I can't seem to find out what their level of broadcast quality is. The FAQ page recommends I install a free program called NexDef but that isn't compatible with Win7, so I should use Mozilla, ok fine, but I don't want to go overboard on video resolution of my devices (1080i) if 720p is all I need to get the best picture possible. Please help me understand the difference between Internet HD streaming video and 720p, 1080i. Thanks.

  • What is a Medicaid Trust?

    Spouse is 82 years of age and in good health but LTC premiums are just too high for us to afford. We do I have a 401k through my employer (aka Thrift Savings Plan) with approx 217K. If my spouse developed significant health issues but had no LTC policy to allow her to receive in-home care Medicaid would not kick in until after half (or all?) of my 401k was depleted. Is there a way to protect this asset, either half or all? Is it considered an asset even if I cannot withdraw it without a substantial penalty until I am age 55? I was advised to seek protection through a Medicaid Trust.

    that ball rolling? Initially I just wanted to work a part time job as a semi truck driver to go along with my FT federal government job. I do not have a CDL but would be willing to pay for any training program that leads to that. I have a good driving record, professional background, drug-free, no criminal convictions. I am retired military, willing to go through a paperwork process to get a clearance that does not involve a great deal of money (beyond basic truck driver training). I work ten hour shifts as a federal employee but in a two week pay period I am off 6 days, sometimes two to five days in a row.

    They charge a fee equal to 16% of total debt. What keeps you from being sued by creditors after they figure you have a good job, good repayment history. After late fees and penalty APRs get applied, hopefully you have had principal and/or APR reduced and you aren't sitting on top of more debt and pending lawsuits, garnishment, etc.

    Misdemeanors"? High C & M is understood by some legal experts to be whatever the House considers that phrase to mean. I am assuming here that the Senate would have 60+ Republicans.

    Process

    The impeachment process is a two-step procedure. The House of Representatives must first pass by a simple majority articles of impeachment, which constitute the formal allegation or allegations. Upon their passage, the defendant has been "impeached". Next, the Senate tries the accused. In the case of the impeachment of a president, the Chief Justice of the United States presides over the proceedings. For the impeachment of any other official, the Constitution is silent on who shall preside, suggesting that this role falls to the Senate's usual presiding officer. This may include the impeachment of the vice president, although legal theories suggest that allowing a defendant to be the judge in his own case would be a blatant conflict of interest. If the Vice President did not preside over an impeachment (of anyone besides the President), the duties would fall to the President pro tempore of the Senate.

    To convict the accused, a two-thirds majority of the senators present is required. Conviction automatically removes the defendant from office. Following conviction, the Senate may vote to further punish the individual by barring him from holding future federal office, elected or appointed. Conviction by the Senate does not bar criminal prosecution. Even after an accused has left office, it is possible to impeach to disqualify the person from future office or from certain emoluments of his prior office (such as a pension). If there is no charge for which a two-thirds majority of the senators present vote "guilty", the defendant is acquitted and no punishment is imposed.

    History of Federal Impeachment Proceedings in the United States

    Two presidents:

    Andrew Johnson, Democrat, was impeached in 1868 after violating the then-newly created Tenure of Office Act. President Johnson was acquitted by the Senate, falling one vote short of the necessary 2/3 needed to remove him from office, voting 35-19 to remove him. The Tenure of Office Act would later be found unconstitutional by the Supreme Court of the United States in dicta.

    Bill Clinton, Democrat, was impeached on December 19, 1998, by the House of Representatives on articles charging perjury (specifically, lying to a federal grand jury) by a 228–206 vote, and obstruction of justice by a 221–212 vote. The House rejected other articles. One was a count of perjury in a civil deposition in Paula Jones's sexual harassment lawsuit against Clinton (by a 205–229 vote) and an article which accused Clinton of abuse of power by a 48–285 vote. President Clinton was acquitted by the Senate on February 12, 1999. The Senate vote fell short of the necessary 2/3 needed to remove him from office, voting 45-55 to remove him on obstruction of justice and 50-50 on perjury.

  • I am being investigated by the Virginia Dept of Labor with regard to employing an under age minor who was inju?

    The job consisted of helping me load/unload my personal belongings into a rental truck, then unloading the truck at a shed in another county about 20 miles away. As a result of an accident a serious injury occurred to a 15 year old. He was treated at a hospital for burns to his face from acid. Surgery involving skin grafts on two small areas of his face area were required. Injuries are not disfiguring and do not appear to be permanent. I provided first aid at the scene which basically involved flushing out his eyes with bottled water from an ice chest and calling an ambulance.

    I was driving to work Friday night, May 1, and around 1045 pm while listening to Delilah a really terrific song came on made me want to keep turning up the volume...I was really getting into it. It reminded me of the Chris DeBurgh sound, Lady In Red, from a few years back. I was hoping someone could offer some new male singers or groups that have a great mellow soothing kind of music. In the song I heard an acoustic guitar and a keyboard but what really made the song so nice in my opinion was how well the musicians blended short musical sections together. It was unique (in the sense that Rod Stewart's voice is unique) but not hard driving rock like Bryan Adams. I really liked that song. I will also inquire at delilah.com and yes.com, two ideas I got from this website.

  • Is there a way, without using a taperecorder, to take audio from a dvd?

    I have music (with video) on a DVD and I want to take the audio (of a particular song) and add it to some video and photos to make a VCD. I am familiar with movie making (MS Windows Movie Maker). When I examine the DVD in 'DVD Shrink' I see two folders - one says TS Audio and the other says TS Video. I know how to save the DVD to my hard drive. Can I now go back in, locate and copy my audio file (from TS Audio) and use it directly, or is there a better way?

    If my parents are US citizens and I am born to them in a foreign country (but not at a US military base like Sen John McCain) then am I automatically a US citizen by virtue of my parents declaring me as their child at a US embassy. Am I considered naturalized in that instance? Can I run for President if I am a citizen but was not born in the US or any of its territories?
