As far as employment law is concerned, Soprano did not contract or hire anyone. It is impossible to make a legally binding contract (verbal, understood, or otherwise) to perform an illegal act (in this case a murder). So, these illegal aliens could not be considered under his employ as far as that goes. He only needs to worry about conspiracy to commit murder.
