Check with the police what the nuisance laws in your area are. It may be that during the day, more noise is allowed.

Are there practice rooms in the area that he can rent out? Explain how the noise adversely affects you, and try to arrange a schedule that works for both of you.

Maybe you should actually talk to the guy before you assume that he's just not going to comply. He may not realize its a nuisance to others if nobody tells him so.
