If they have a document with the proper credentials that they were married in Africa, they would be considered married in the USA. They wouldn't have to get married again in the United States. But, they would be investiaged if they applied for anything in the USA as a married couple, such as insurance, welfare, a mortgage, bank account. It's not like 100 years ago when people were coming in droves off boats. The Patriot Act is still in effect and if they attempt to prepetrate a fraud, they'll get caught.

Yes it is legal if they have all the proper documentation.

What they should of done though - which would make it easier if in the future they need to get at their records was get the forms from the U.S and get the registered there and then gone over.

I know you can do this in N.Z at least. It is much easier to get your documentation in the country you live in you see.
