Do you need a lawyer for a Fiance Visa application?

If you are an American considering marrying a foreign national do you need a lawyer or can you just fill out the paperwork?

    It's not difficult to do the paperwork yourself as long as your application is straightforward. If your foreign fiance has any convictions you may be better with help from a lawyer but even in cases like this people have managed to file successfully without paying for legal help.

    The forms are long and annoying to fill out as each form asks for more of the same information. It is important to check and double check everything as accuracy is very important.

    If you do use a lawyer it can actually make the process take longer as you still need to gather all the supporting doccumentation, you then have to send it or take it to the lawyer who will fill out the forms and send them to you to check and sign. Really when you pay a lawyer you do most of the work yourself anyway.

    The United States is a very large country and so is Russia. Both countries have plenty of women and men that would make great spouses. In case of the United States, women who live here come from all corners of the world, all religions, and all ethnicities. There's a women here for you, and probably a few thousand others, who would make a fabulous spouse, no matter what rocks your boat. Same in Russia. A Russian woman will be able to find a husband easily in Russia or one of the countries of the former USSR. So the reason why an American man will want to get married to a Russian woman living in Russia is often that he can't get laid in the US. Either he's a mental case or a perv or just so demanding that any normal women would tell him to get lost. He thus hopes to find a Russian woman who will be more submissive, puts up with him, in return for a Green Card. But exactly that is what the US government wants to prevent: marriages for a Green Card, and Russia is in the top 5 worldwide. There are entire order-a-bride scam operations doing nothing else. Thus, your fiance will not be able to get a visitor's visa to the US, aside from the fact that entering the US on a non-immigrant visa with the intent to immigrate is visa fraud, a felony, that would get her barred for the rest of her natural life. So if you have test driven your fiance properly, tested her under all kinds of conditions and are sure that this is the woman you want to spend thousands of your hard-earned dollars on, and are also willing to sign your financial life away, potentially for decades even after you have been long divorced, you will file an I-129F petition with the USCIS. A bit later they will ask for an Affidavit of Support, form I-134 and a biographic information of both of you, form G-325a, and eventually your fiance will have her interview in her country, most likely 10 months or so away. If the consulate believes that your relationship is bona fide and you have visited her often enough, have her family's blessings and everything is kosher, she will get her fiance visa, the K-1. She then has 90 days to get married to you and afterward you will have to file for Adjustment of Status, which costs $1,070. Once approved, she will get her conditional, 2-year Green Card. Before that expires, you will file for Removal of Conditions, and thereafter she can divorce you safely and bring her real boyfriend from Russia over here while you'll be paying through the nose for this.

    It depends on following factors:

    1. Your financial situation.

    2. Amount of time you have on your hand.

    3. Your ability to read important information which has legal consequences on your personal/family life.

    4. Your attitude towards things.

    5. Peace of mind you need during the process.

    Most of family based immigration paperwork can be handled by someone who does not want to spend money on lawyers or can not afford one, does not mind making a mistake, or is pretty good at reading forms and instructions, collecting evidence and filing correctly.

    If you are one of those, yes, you can.

    But if you are someone who is not detail oriented or likes to have peace of mind and does not mind paying for that satisfaction, you should hire a lawyer. One mistake can cost you time and frustration in relatioinship, lack of confidence (by your fiance/wfie), etc.- even though you might be able to solve the problem later.

    You do not need a lawyer to file the petition, but the process can be confusing. If you want someone to do it for you. Try a reliable visa processing company that does it for a lot less than a lawyer but offers the same results. I used http://www.ezvisa.us/ and got my fiance to the US in less than 4 months.

    You can do it yourself. However, be very mindful of the process and make sure you fill out your paperwork VERY accurately. I've worked with immigration in the U.S. before, more specifically H-2B non-immigrant workers. I can tell you that anything dealing with immigration can be done by the average person.

    As long as he doesn't have any kind of criminal record then you can do it on your own.

    Fill out the paperwork, follow the instructions and before you send it off, copy *everything*.

  • You do not need a lawyer; you can do it yourself. Just read the instructions thoroughly and comply fully so there will be no unwarranted delays.
