Are "upskirt" photos illegal? Should they be?

A Tulsa, Oklahoma judge just ruled Riccardo Ferrante did not break a law because he took an upskirt photo of a 16-year-old, at the mall. The judge deemed the girl not having any privacy because she was at a mall. What???

    This ruling is contrary to most other rulings on the subject. There have been others that went the same way, though, so several States - but not all - have specifically passed laws banning upskirt pictures.

    I, personally, think the judges ruling is legally flawed. Yes, if you go to the mall I can certainly legally take a photo of your face - you have no "reasonable expectation of privacy" in that respect. BUT.... you do not have any expectation that someone will look up your skirt with a cell phone, so as to the area inside your skirt you DO have a reasonable expectation of privacy.

    He may be legally right and moraly wrong depending on the laws of his county. If they aren't they should be without the permission

    I thought they were illegal...but i guess not...i definitely think they should be illegal, because that's invasion of privacy

    Sorry, but I will agree with the judge on this one. If you are wearing clothing that allows people to see parts of your body that you want to keep private then you run the risk of people looking. If the girl didn't want people to see that part of her then she should have covered it up better. IMO, if you wore a low cut shirt to work that exposed a lot of your boobs, then you shouldn't be able to sue your boss for sexual harassment if he looks. You may not like my answer, but that's what I think.
