Is this rape?
From a 1994 case.
This man claims he was raped by a woman while drunk and passed out at a party. Witnesses support his assertion and a doctor testified it was possible. For those that don't think it's possible, consider that "wet dreams" happen while a male is unconscious. I say he was raped. You? Also, should a man who is raped in this fashion, or a teen-age boy who is molested by an adult woman have to pay child support?
JG, child support should be for the benefit of a child in need, not to a single mother that can afford her "choice" alone. Apparently, modern "morals" deems a child is owed no matter what, even if a father has to go hungry, move in with parents, or work slave wages at two jobs for a child he didn't want. Especially in this case. The state should have to pick up the tab.

Any time sex is forced - male or female - it is rape.
That seems particularly cruel of the woman to sue him for child support. This guy was rail-roaded.
What a horrific experience for him. I'm sure he got flack too for even pursuing this.
Women like this make those of us who have been raped a joke. I hate this crap...

He passed out so obviously he didn't give a consent. So he was raped. Was the woman drunk too? If she was drunk, it would be no one's fault. Nonetheless, the guys doesn't need to pay any child support. This I know for sure because I'm a peer educator who gives program that is designed to promote greater awareness about the dynamics of sexual assault and aid in the prevention of relationship violence on campus, in hand with the campus police and local rape crisis center.
Here's a legal definition of rape:
The crime of rape (or "first-degree sexual assault" in some states) generally refers to non-consensual sexual intercourse that is committed by physical force, threat of injury, or other duress. A lack of consent can include the victim's inability to say "no" to intercourse, due to the effects of drugs or alcohol. Rape can occur when the offender and victim have a pre-existing relationship (sometimes called "date rape"), or even when the offender is the victim's spouse.

Of course it's rape! If anyone has sex with another person without his/her consent, then it is rape.
As for the child support-no, he shouldn't pay. But now a child is in the world and it is the child who will suffer.
The child support system is all messed up. Yes, it is intended to help the children, but as my fiance has learned, they do not like to help the men out. Whenever we go into the child support office, they assume he is a dead beat dad and basically treat him like #hit, even though he has 50% custody and he still has to pay child support.
Really, it is the child who will pay for these misfortunes.

Yes it's rape. This is a terrible story, but I'm honestly not the least bit surprised he got the raw end of the deal. Heck I'd been surprised if he hadn't.
To sssh above: If she was drunk she very damn well is responsible. If a drunk man has sex with a passed-out drunk woman that's rape isn't it? Of course it is. If a drunk driver hits and kills somebody they're responsible. Just because you're drunk doesn't mean you're not responsible for your actions. You shouldn't have gotten drunk in the first place.

If a male or female did not willingly give consent to sex and/or was impaired (drugged, drunk, etc), and someone had sex with them (male or female) it was rape. It doesn't matter if the "doer" was drunk, they did the deed, they should be punished. If a child results, whoever was the rapist should be responsible for the support of the child or should be responsible for paying for the abortion. Gender doesn't matter-consent and the *ability* to give consent matters.
And yes, men can be raped in multiple ways. If you don't know how, get some sex education, you need it.

Did he give consent for sex? No. Then, yes, he was raped.
That said, it is not the child's fault it was born. Even though it is not the least bit fair for him, he should have to pay child support. Personally, I would sue for custody of the kid. A rapist has no business raising a child.

Yes, it is rape. And no he shouldn't have to pay child support.
Mind you, paying child support is a hell of a lot less painful and emotionally scarring than carrying, giving birth to and raising the rapist's child, like so many of the anti-abortionists who rant about the baby would have hundreds of young girls and women do.

Yes it is rape. And yes it is possible. My ex girlfriend claimed to have sex with me while I was sleeping. And NO they shouldnt have to pay child support because they were ****** raped, not willing to have a child and didnt choose to have sex with someone while knowing the consiquences of it.
Source(s): Criminal Justice class, the ex girlfriend thing, and common sense. - SLv 71 decade ago
Yeah I think so. And he absolutely shouldn't have to pay child support, it was the girl's fault and her fault only. She should actually be in jail for doing that.

Yes its rape!
and no child support.. he didnt make the child... she kind of stole it from him. If that makes any sense?
