My husband lives in Trinidad, we have been separated 8 yrs now. We have no property or monies tied together. My son has been with me since he was 5 yrs, he is now 13yrs. I want a divorce, but my husband refuses to sign the divorce papers. What do I do.?

Because he is in the Navy this means that he right now is on Sea Duty, there is no way that full custody will be granted to him. There is a possiblity that he could get part time custody but that will depend on the judge and where this divorce is taking place. With the amount you are getting does that include part of the BAH and the separation? Because legally he is obligated with a separation not divorce to give you part or all of the BAH. For the debt that he has, it too can depend on where you are doing this divorce, a few states require it to be split 50/50 whether it is yours or not. Is your name on the any part of the debt? Now JAG can't help with the divorce at all they can only give you a lawyer's name that might be able to help you. You can see if they have any recommendations or talk to the Navy Chaplain. He doesn't have to sign anything. Contact a lawyer, and start the divorce proceedings. Do you have any contact with him at all? If not, all you have to do is post notice in the local paper at his last known address. If you do have contact with him, advise him to get a lawyer...if he doesn't, you will get your divorce regardless. If he does get a lawyer, you will stil get your divorce. Once he is served with the divorce papers, he will have 30 days to file an answer (in other words, decide if he wants to fight for anything). If he doesn't file an answer in those 30 days, your divorce will be scheduled and once you go to court on that date, you are divorced.

You dont need him to sign. Check with a lawyer, but I think posting your dissolution in the Legal Notices of the paper for 3-6 months will activate your divorce.

Write up your divorce papers using a lawyer and even if he does not show up in court (abandonment) an judge will grant your divorce.

Check the laws in Florida. In many states, you can file papers and if they don't signed by a specific time, then you are automatically divorced. If you have to have grounds, then you can sue for abandonment.

Start the proceedings, the courts will not allow that for long. They will enter a judgement without his signature, however, like I said, they will make every attempt to get him to reply before going that far. Good Luck!

your attorney should advise you. not sure, but it could be that his not signing ...the papers will go to the court with refusal to sign and the judge would grant the divorce anyway without the signature. ask your attorney.

Get a lawyer and file. He doesn't have a choice. He'll have the opportunity to appear in court.

does it make any difference ? u can do things legally as well as illegally.
And, best way to get higher, is illegal (forgot that famous saying?)
