i left my two minor childrems live with my ex-husband because him keep the house and has a good job, actually i dont have a job i cant care my kids but i really love so much my kids his married again and this lady doesnt have kids i believe she influyed in this case and is a false accusation i going to the court in a week i dont what i need to defense by myself i dont have money to hired a lawyer please i need some recomendation i live in miami florida
whem i said i dont have a job i have a parnet to help to pay my apartment and everything he is a good man i living with him since two months ago and he like my kids so much i never didnt nothing to my kids im a good mother my ex his is the abuse in the married mental and physical but i never accused him because i dont want to hurt my kids.

Have you not been appointed a lawyer for the defense of your case. They have to offer this. Call the court and tell them you need a court appointed lawyer to defend yourself.
You can give up custody of your kids and ask for visitation and offer this in return for him dropping the charges, in case you have no way of proving your innocense. I would ask for a contract and make sure that the contract says you do not have to pay child support, and that he is only getting full custody on the grounds that he drops charges.
It is hard to give up your kids, but if they are well cared for then it might be better for them. They will come back to you when they are grown and be close to you again, I promise.
This way you will at least be able to find a way to start taking care of yourself.

First - you need to contact legal aid to ask for representation in your court case.
Second - you must realize that he already has custody of the children so I doubt that was his motive for filing a domestic abuse claim.
Third - his wife may insist that he report the abuse, but police will not pursue a case of domestic violence unless there is some proof that the violence has occurred. Your ex-husband chose to file the domestic violence report.
Please focus on the charges filed against you, they are not about the kids or the new wife. It has to do with a fight with your ex-husband. If it is false, you will need to defend yourself against the allegations since not only was a report made, but they felt there was enough proof to pursue this in court.

Go see a lawyer or find a legal aid officer.
First few minute will be free and lawyer must tell you the cost, see if a lawyer will give fix price. See a couple of lawyers and then make selection, write down Qs? you need answered from the lawyer and take a note of the answers from all lawyers.
See some one in family court. See what they are saying.
Start with your divorce lawyer. This one knows the history so it may be cheaper.
Do not let them adopt the children.

I would say you are out of luck on this one. Your situation just emphasizes the reason why every woman should have an education and a career. Because you cannot care for the kids, have no career or job, your husband will get full custody. The courts go with the person best able to care for the kids.

It all depends on what your custody agreement says. If you have full custody of the children, then you'll likely be able to move....if the agreement says nothing about traveling or moving out of state and you think your husband will fight it you will need to return to court to amend the agreement. If you show proof your job is moving you to Florida, and the benefits of moving (i.e.having a job, providing for the kids, etc) then the judge will not likely stop you from moving. All your husband can do is give his reasons for him wanting you to stay....

remember he has the burdeon of proving to the judge that what he said happened. if it is all al lie try not to worry too much about it. if you have any witnesses that can help you get them. what did he say you did anyway? if he does not win the case he will not be awarded temp. custody but while the kids are living with him you will not be able to see them until you get court ordered visitation or custody.

Dang!! That was hard to read.. Anyways,You have no chance unless you can get legal council...As far as the domestic violence, He will have to prove that you were violent towards him or the children... Hard to prove with any evidence.(police reports,hospital records,ect..)
