It more than likely was not DUI. You were arrested for DWI or Driving While Impaired. DUI takes a BAC of .08 or above. However one can be arrested for driving while impaired if under the influence of alcohol or other substances that would impair ones ability to operate a motor vehicle. If it wasn't against the law, you would not have been arrested.

It depends. If you were over 21 you were under the legal limit of .08. Were you impaired in any other way?
If you are under 21, however, you are breaking the law if you have any detectable amount of alcohol in your system.
