my son had court date 8/24/09 and in jail waiting.dui blew .06. and being charged with poss.control substance?

i called my sons court appointed attorney and was told prosecuters not ready and no new court date has been set? san antonio texas.how can prosecuters not be ready?

    Because the criminal justice system is so overloaded with very serious crimes, that relatively minor offenses -- and no, I'm not saying that DUIs are minor, especially given the fact that so many people are hurt or killed every year by drunk drivers -- but the fact is, the system is overloaded, and some stuff gets pushed to the back burner.

    However, the prosecutor cannot just willy-nilly push something to the back burner. He has to have agreement from the defense side, and the defense SHOULD have obtained permission from his client because of the Speedy Trial act.

    If the prosecutor told the judge that he needed more time to prepare his case, the judge would typically ask the defense if he objects. The defense would have to say, No objection in order for the case to be pushed back.

    The court system is incredibly backlogged in many places. In most areas, the prosecution or defense can call for a continuance, but a court date is required to do this. Awaiting evidence or "discovery" is a common reason. You should receive a court date soon, but by soon I mean within a month or so. The wheels of justice turn slow here in the USA, There are many other countries where the wheels turn fast, but usually end up with a life or death sentence for the smallest offenses.

    That relies upon on the courtroom - he needs to flow to the courtroom ASAP and flow to the assigned decide ask to communicate to the general public defender and defined why he neglected the date(it had extra effective be solid - no longer purely over slept). the faster he gets to the courtroom the better it is going to choose for him. If he waits too long he might desire to land up with a warrant and a fee of contempt. solid success!

    Could be they are waiting for drug test results to present in the case, if he was charged with a controlled substance as well as dui.
