Are there any laws against where someone can put there dock on the lake?

We live at Lake Lanier in GA on a large peninsula. Last year, because of the drought, we let our next door neighbors move their dock to the other side of ours so that their dock would not end up beaching. It was within 10 feet of ours and really crowded. Now, the lake is flooding and we want them to move their dock back to their spot (where their power poll is, its about 100 yard away). They said they wont and they dont have to. What can we do? Is there laws about this? Who do we call?

    I don't see anywhere that you mentioned to them that you would require them to move it back.

    And if they were permitted to move it there, with your permission, it's allowed to be where it is now.

    No laws. Nothing. You can file a complaint, but that will get overturned the minute they mention that you allowed them to do it.

    The location of all docks on Lake Lanier is regulated.......you need a permit to Build or move any dock.......due to the low water conditions the movement of your neighbors dock was and is considered temporary....their permit is for it's old location, so they must move it back there. The US Army, corps of Engineers will help you on this issue. Just contact them.

    It could just up and float off in the middle of a storm at nigh!!!!!, so the mooring rope broke and it is no longer attached to its anchors, be a good neighbor and go get it first thing, and tow it back to its original location...., then after you and your neighbor get it all set up, have a few beers with em' and all is well, I know its a little work on your part, but it keeps the peace and you get your dock back!

    Sounds like it's already getting ugly.

    that lake is under the jurisdiction of the U.S. Army Corps of Engineers.

    There's a link there to Corps policies and regulations. They have a fleet of Apache helicopters to deal with non-compliance. Jus kiddin

    If the docks are all compliant with the COE regs, then I wonder, can they get to theirs without crossing your private property? Careful, there may be some subtlties surrounding the concept of "private property" where "public waters" are concerned.

    If they can't, you should study your state's laws regarding "criminal trespass" and post your property accordingly. You would call the sheriff to report non-compliance. There will also be laws regarding "civil trespass," for which you would file a lawsuit.

    Maybe they just lack the resources to move it again? doesn't really matter. You may end up having to move yours, to deal with the overcrowding.

    Hope you haven't got yourself on bad terms with your neighbors, that can be kind of unpleasant.

    You have to get a permit to put it there. Most times your also required to have some type of lighting on dock and reflectors so it can be seen at night by boaters.

    Contact your fish and game department and ask them. Also check U.S. Coast Guard regulations. It may be considered a hazard to navigation. You can also check with your county law enforcement. There may be an ordinance violation or you may be able to get a court order to make them move it.

    dont see the big deal you was nice enought to let them put it there why move it at all

    it wasnt in you way before

    water stil same just higher

    but if they using your power that would be a problem

    just shut it off that you can do and the land they walk on well is it your land if so you have control over who walks on it and if its on your land its your dock not theirs can do what you want with it

    If it comes out from their property and doesn't violate any setbacks you might be out of luck.

    Also, you invited it, so that is strike number two.

    Can you offer any incentives to them to move it back?
