To SUE or NOT TO SUE?
I hate "sue happy" people, but right now I feel very torn about going to the law about this issue: My son is in the 4th grade and goes to public school. His school was giving out the H1N1 vaccinations last week (during the school day, which is crazy), and I returned a consent form specifically stating that I do NOT give consent for him to to receive the vaccine. Well...you guessed it, they gave it to him anyway. My rights were completely violated, but I'm not sure how far to take it? He could have had a pre-existing condition that may have caused a reaction with a vaccine, but no one checked! We are all lucky he didn't get sick or die from it. But that's not the point...the point is that it was completely ILLEGAL! I feel really sick about this. I called the principal and she contacted the community health nurse who administered the vaccine. That nurse called me and appologized sincerely...but I'm not satisfied. I am not at peace with this yet and don't know where I should go with it. ANYONE???
Okay..for all you people who have never read the constitiution of the United States, don't answer my question. I don't care whether the shot was safe or not, that's not the point. They could have been injecting him with saline for all I care..the point is that it was completely illegal doing it against my consent. We're not living in a country where government mandates whether we get vaccinations or not. My damages?? Well, I do not sit well with my rights being violated. Yes it was a mistake on thew nurse's part, but no -I'm not just going to GET over it. Someone is responsible for this and it will not just be brushed under the carpet. If it could happen to my kid who knows how many others it could affect. How should we let something like this go to assure it never happens again? Maybe when a child is killed? Then would it be right to sue? I don't care about money as much as I care about the admission of the grave mistake, and the assurance that will never happen ever again.

go sue dammit, hes YOUR SON so sue not theirs.
if that happen to me , my mom would be soooo pissed. if i was in your shoes, i would sue.
my mom didnt want me to get it cause what happens when i get older? will i be able to have kids?

That said... (( I don't care about money ... )) Lawyers *love* this. It is almost always about the money, truly. But assuming you're not seeking damages (which there don't appear to be any):
(( as much as I care about the admission of the grave mistake, and the assurance that will never happen ever again. )) You were already given a (hopefully) sincere apology and assurances that they'll be more careful in the future. How would suing anyone/everyone make that assurance any "better"?

What are you going to sue for? You have no "damages". You can't sue just because it happened. If you son DID get sick, and you had medical bills, then you could sue for them. But you can't sue just because you're pissed off.

I say sue them. How would they feel if it were them and you gave thier kid the shot anyway.
They could have gotten your kid sick and he could have died from it. Even though he didn't I still feel like you have the right to sue. They violated your rights. Good Luck!!

sue if you refused the shot and they gave it tell the principle they are now responsible
for that child's health for the rest of his life

It was probably just an honest mistake... your son is fine, there are no real or punitive damages, what is there to sue over? Get over it.
