Is it illegal to discriminate smokers in the workplace?

I am looking for a job and recently came across a posting that said "Please, No Smoker!" I am not a smoker myself, but it got me wondering if it is illegal to refuse to hire a smoker. The posting is in Minnesota. Do different states have different laws? Here is the posting for the job:

    Of course it's legal. Smoking affects the worker and it affects the other people in the workplace.

    Smokers HAVE to get their nick fix periodically, which means that they are taking breaks that they aren't entitled to, even if they smoke at their desk (which of course they usually can't do any more). This means that the nonsmokers have to take up the slack. I used to work with a heavy smoker, and she'd disappear into the bathroom about every 45 minutes. This meant that I had to quit doing what I was working on (I was working in the deli, and had to make salads and sandwiches) and cover her cash register. Then the boss would yell at ME because I hadn't made up all the salads and sandwiches. I finally said that I wasn't willing to work on a shift with her. None of the other workers would, either, because she was always running off and lighting up, and because the bathroom always smelled of smoke.

    In some jobs, it's hazardous to smoke, for instance around flammable materials.

    Plus, many smokers just smell like a dirty ashtray, and are not nice to be around. Some smokers don't seem to smell like this, but with most smokers, the smell is in their skin, not just in their clothes.

    In this specific case, the company is looking for someone to be at that desk, not out back having a cigarette, and they are also looking for someone who is presentable. It's a totally reasonable requirement.

    I worked at place where smokers had a hard time getting hired. The reason is because smokers often take breaks during work when they are not supposed to (to smoke) and also smokers are more likely to have health problems which cost more money to companies. Also, some people do not want to be around others when they are smoking.

    i don't think of you may make that a query on any application or in an interview. yet you may make policies that make it very confusing for people who smoke to artwork there. Now i might say if somebody have been to illuminate in an interview that that's extremely unprofessional or maybe rude. and that i might say on the grounds that people can discriminate on the visual attraction (way of gown and how they modern-day themselves in the interview) If the reek of cigarette smoke then flow a head and don't employ them in step with that. additionally remember that hiring is a discriminating enterprise. you need to discriminate on some grounds. merely make certain you may back it up by making use of alternative than he's a smoker.

    Yes, different states have different employment laws, but most have what is called 'at will' employment. That means an employer may refuse to hire you or may fire you for almost any reason. The only reasons they would not be able to refuse to hire you or to fire you would be things like race, religion, sex, etc.
