being separated from your wife?

My wife moved out about 4 weeks now,She wants to get a divorce and doesnt want to work it out.So we havnt done any papers saying wer separated.She signed a lease with lady she is staying with so there is something say when she moved out.But what i want to know is.I have gone out with friends and a couple date.Have not done anything other then kiss my dates.One lefted a mark on my neck and my soon to be ex wife saw it and is getting pissed off.So is there anything she can do to my by law just cuz someone lefted a mark on my neck?didnt have sex just kissing.

And yes i know it doesnt look good for me or good at all to leave a mark on someones neck.

    Answer: NO.

    This is America and you're free to date and kiss anyone you want. Though many states still have adultery laws on their books, they usually require coital sex, not kissing.

    The other thing is, adultery laws have all be overruled by Lawrence v Texas. So consenting adults are allowed to have sex even if they're of the same sex. The state has no interest in it.

    Finally, if you're both separated and she's set up her own independent economic unit, as in an apartment, she's evidenced her intent to separate without the intention of remaining married.

    Hence, the separation could mark the point, depending on which state you live in, where your wages are your own and her wages are her own.

    Therefore, if I were you, I'd rush to the courthouse, file for a divorce and make sure that she can't dig into your paycheck.

    She moved out. She wants the divorce. -And thankfully? There is nothing she can do about your going on with your life and going out with other women. The law could care less about this type of issue when it comes to such a divorce. I hope you will take this time to date more and figure out what you want out of life and what you need to give and get, in order to have a possible future marriage. It does sound like you may have married too young, dunno.

    Don't worry dear, she can't do a thing and she certainly has a lot of audacity to be "pisse* off" afterall, she left you, she wants the divorce. She sounds like a real flake <sorry>

    Not really. She can claim infidelity to the courts but if she does that, you can claim desertion (meaning that she deserted you when she left the house). Play fire with fire if you have to. But honestly, a mark on your neck and hearing this story as a judge, wouldn't really make them be harder on you or anything. Its believable and pretty normal for separated couples to date around before the divorce is final. Stop worrying and just be more careful. You're not 15 anymore, don't let women leave hickeys on you. Gross.

    You two are separated. You can do as you please. She should get used to it now. You'll be divorced soon.
