if you take someone to small claims court and the dont show up?isnt that illegal or something?

they damaged my vehicle, tried breaking into my shop, and stole an a/c and mini fridge before they left as a tenant. i live in south carolina any help would be great

    Of course it's not illegal.

    If you sue someone, properly serve them with notice of the lawsuit, and they fail to appear - then you win the lawsuit by default.

    Unfortunately, this just means you get a judgment against the defendant. It doesn't mean you collect the money.

    The guy loses the case and has to pay the deal, but sometimes they never pay !

  • If they don't show, you will win by default. Collecting will be your next step.
