In Calif if you are married for 6 yrs and you are disabled would you get..?

any spousel support? Being together of a total of 11 yrs..and being dsabled over 5 years.

    if it involves social security disability io years is there going rate.smile all the way too bank now

    Okay, legally in any State, any State, if your on Disability, it does not matter how long you have been married or even single, you still get the same amount of pay.

    Social Security and yes even Social Security Disability, it not based on any marriage at all, it is strictly based on the time you worked and what you have paid into Social Security.

    It is based on nothing else.

    So, for one if you never worked in your life, then you cannot draw any type of Social Security...

    Even when you turn 62 and want early Social Security, you are not gonna get it, cause you did not work during your lifetime.

    And at 65 even, if you never worked, no pay, you will not be able to get Social Security.

    If your totally disabled and getting Social Security, then you have had to worked during your lifetime, Social Security is only based on how much you worked during your lifetime.

    It has nothing to do with a Spouse or being married or not married.

    And to also let you know, you are eligible to get on Medicare at any age if your disabled, but you have to wait exactly 2 yrs from the date of your disability onset....

    Totally disabled is entitled to Medicare at any age.....

    And, if you cannot afford to pay your Medicare Premiums of $115.40 per month, you can contact your States Department of Health and Human Services, and you can get your State to pay your monthly Premiums for life, yes you can.

    No need to go without medical ever again, so check into it, if it has been 2 yrs since you were awarded your Social Security Disability, they will send you a letter telling you when your Medicare Part A and B will begin, it will be exactly 2 yrs from the date you were approved for Disability.

    I keep up to date on all the changes and things to be done to get things done for Social Security and also Social Security Disability cases.

    And no, you cannot get any Spousal Support, by being disabled, unless in your divorce decree the Judge awards such to you, and if you have been awarded Spousal Support and then got Disability from Social Security, you have to notify Social Security of such income, as they will then lower your monthly payments for your Disability, Spousal Support is considered income, and it has to be reported to the Social Security Administration.

    If you do not, and someone like your ex spouse reports it instead of you, then you could lose all your Social Security Disability Income for withholding the information.

    And, the Social Security Administration can also track back to the date you began getting spousal support and make you pay back any amount that you have gotten off your Disability,.

    So, if you wish to keep your Disability for life, if your totally disabled, I would not demand spousal support, you can have one or the other, but usually not both per Social Security....

    But, at age 65 you can apply and draw your Social Security and get spousal support as well, but not if your drawing Disability pay.
