Yes, they can sue.
The one needing the police report it's you because now your insurance can refuse to pay. It's also illegal not to report a car accident in which you hurt someone.
If it's a just minor injury try to reach a deal before going to court. If getting a lawyer costs you more than paying the guy then it's not worth fighting over it. Make a reasonable offer to cover for medical costs and troubles; start low and go up from there.
