Rights of a Lesbian Co-Parent?
Rights of a Lesbian Co-Parent?
I am asking this for a friend who is having trouble with her ex.
They were in a lesbian relationship for a few years. while together they decided they wanted a baby and used a friend as a "donor". When the child was 2 they split and her ex has stopped her seeing the child. Does any one know if she has any rights to see the child? Her ex is currently back in a relationship with the child's dad and pregnant with another child.
any advice would be gratefully recieved. She still sees the child as "her son" and would love to be involved in his life but doesn't know if she can take further steps towards making sure she gets contact with him.
FI - the only reason she is not getting to see the child is her ex told her is she did not get back with her then she wouldnt let them see their child.

It depends on the state. Some states have laws strictly prohibiting same sex co-parents and others are more open to being fair about it. If she didn't legally adopt the child though I am assuming it's because she legally couldn't in her state and that probably means she has no rights.

By co-parent? Is that officially legal? Did she adopt the child with her girlfriend? If she didn't then sadly she doesn't. I think you should advise her to consult a lawyer to see what her options are.
