    There are 9 community property states

    Arizona

    California

    Idaho

    Louisiana

    Nevada

    New Mexico

    Texas

    Washington

    Wisconsin

    These states a 401K would be owned equally by husband and wife though one probably could draw up a an agreement that only property acquired after the marriage would be split

    Get a pre nup and avoid the issue

    Only the portion amount earned or saved during the marriage.
