Car Accident Help will I be prosecuted?

I was involved in car accident but need help as I'm blaming myself totally, my friend said not my fault! But I can't help feeling responsible as I was driving. No one was seriously hurt just cuts and bruises! I was travelling along a road a red van overtook and cut in tight causing me to break sharply I tooted him as I had kids in car and thought it was dangerous as I was only doing 30mph but he cut in that tight nearly hit him, he was in front and started to do hand signals out of window I ingnored as thought not going to react as we come off roundabout he slowed right down I thought he was going to cause a row so I went to overtake him the road was wide enough for 3 maybe 4 cars easily, as I got level with him he swerved into my car I breaked and he kept coming so I swirved and a car was coming the other way so we had head on, I was doing no more then 30 mph but other car was going quite fast so was quite bad accident. The van drove off! I keep asking myself why would someone want to do that? I would never drive dangerously and can't explain as happened so fast! The thing is at end of day I was across road in middle so I feel I will get done for dangerous driving, I haven't heard from police or anything as of yet Im just grateful everyone was okay! There is cctv so hopefully they will find this red van and driver before he kills someone!!

At no point was I being aggresive I did not want to get into conflict with him at all I was trying to avoid a situation yes I agree it was bad judgement I wish with all my heart I went a different way but I even left loads of room he literally waiting for me and was forced to overtake or wait behind and at time I thought if I stop I don't know how many people in that van or what weapons they had I honestly at time thought I was doing safest thing not for one istance did I think he would do this!

    Unfortunately for you the accident is YOUR fault in the eyes of the law. Just because this guy in the van was an **** doesn't mean that your actions are OK.

    I feel for you as clearly you thought you were doing the right thing. You ahould have pulled over and let them drive on rather than get into anything with hime on the road.

    I think it is unlikely you will be procsecuted for that if your facts are correct as it was just an accident but my advice would be to preempt it and contact the police yourself if you are concerned. You could report the van driver as a seperate incident and hope they decide to prosecute based on CCTV.

    Of course you feel guilty...it's your fault.

    You engaged in road rage. You don't want to call it that...but that's what it was. You crossed the center line to get next to him. Way more to that story than you innocently wanted to pass.

    When another car is acting like an idiot, the best thing you can do is leave him in front of you with plenty of space between you. That way the idiot can't follow you home. He can continue acting like a fool and you're not involved. If it's bad enough, you take out your cell phone and call the cops - give them the tag number (cause the vehicle is right in front of you) and report his reckless behavior.

    If you have too...you turn off a side street and loop around the block and let him get well up the road and away from you.

    I had a car acting like a fool trying to start something with me when some friends and I were going to play mini-golf. Rather then mess with them, I just turned off and headed toward the police station. Figured if they followed me that long, they'd go away when I turned into the police station parking lot.

    The red van did not try to kill anyone. You did.

    You're the one that crossed left of center.

    You're the one that continued to engage in reckless behavior with a fool.

    You feel guilty for a reason. Whether you admit it or not, you know that you continued to engage in reckless behavior and only added to the situation.

    red van man was being a complete idiot and i totally sympathise with you. you should have pulled over and let him go and if he stayed to annoy you then you should have called the police.

    i'm assuming that as the accident sounds quite bad then the police were called to the scene? they should have breathaylised both you and the other driver. if you were going to be arrested for dangerous driving then they would have done it at this point.

    i'd say it was just an accident, more poor judgement than deliberate dangerous driving.

    It is not the best thing to overtake him but it is not illegal for you to do that. His act of deliberately threatening you - with his vehicle - by swerving at you is a criminal offence. Your overtaking him, at the time, was not wrong, his malicious interference with your normal driving was the whole cause of the accident. He prevented you from carrying out a perfectly normal overtaking procedure.

    You have nothing to worry about. But you learned a good lesson - when arseholes like him are on the road, pull in and stop.

    The mere act of you attempting to overtake the van IS in fact "dangerous driving" - regardless the speed.

    For future reference: NEVER lose your cool behind the wheel. ALWAYS be in control of yourself, and allow jerks to pass you. A jerk is a life time thing, as you can't fix stupid. Don't end up a victim over a jerk. Good luck.

    its obvious its an "twist of destiny" your insured, admitted criminal duty permit your coverage employer choose. the police wont do a undertaking only use that as a scare tactic to youthful drivers
