My Friend does not have Driving License, Driving my Car. If Police catch Him while driving what happens catch him while driving what happens?

Do Police Charge my Car for any reason..? Do Police charge if I am in Car if he is driving..?

Please give me more info on this matter. Please share known experiences if there are any. Thank you

    If your unlicensed friend is driving and is pulled over, he might be ticketed for not having a license or he could be arrested. Your car could be towed to an impound lot. If you are in the car, they might release the car to you. Or they might have it towed to "teach you a lesson." I don't know if you would be cited for letting him drive the car. In some jurisdictions, that is probably a crime.

    Bottom line...no good can come from letting your unlicensed friend drive your car whether you are with him or not. Help him get a license and then suggest that he buy his own car!

    UK answer.

    YOU get the same charges as he does for permitting.

    Your insurance is void and you will not find getting insurance easy in the future.

    Your car is towed and impounded at your expense. If you do not recover it within 2 weeks it is sold or crushed. To recover it you need new insurance.

    He will find getting a license for several years almost impossible and if he does the insurance will be extremely expensive.

    The good news for you is after permitting him to drive you will probably not need your car as you will lose your license as well.

    State laws vary as to penalties.

    The car could be impounded. There could be large fines and possible imprisonment. Any application for future driver's license could be delayed by years.

  • Sounds like your friend needs to read the state constitution, state statutes and learn some law to protect themselves.

    As far as what happens, that depends on whether you want them to fine you under the transportation code or not.

    Drivers are for hire.. vehicles are for hire.. operators are for hire.

    If he or you turn over your drivers license and or registration or proof of insurance, they can say your friend is under the transportation code.

    WORDS MEAN THINGS IN LAW: the transportation code talks about "drivers", "vehicles", "operators" etc. Look at your state statutes for those key words and look up the definitions in the state constitution and statutes. (Hint, those words mean something other than what most people think they mean)

    (a) Definitions. - In this chapter, the following definitions apply:

    (6) Motor vehicle. - The term "motor vehicle" means every description of carriage or other contrivance propelled or drawn by mechanical power and used for commercial purposes on the highways in the transportation of passengers, passengers and property, or property or cargo.

    (10) Used for commercial purposes. - The term "used for commercial purposes" means the carriage of persons or property for any fare, fee, rate, charge or other consideration, or directly or indirectly in connection with any business, or other undertaking intended for profit.
