    You can try, if you actually suffered some kind of damages.

    Yes. James is correct that the comment must be "published" somewhere. Also, you must incur some form of damages, for example harm to your business or job.

    Depends, the comments would have to of been made in the public domain and a record of them, E.G. an email or Facebook post.
