Interesting one. Maggots in tooth paste. I had a problem like that once. Not tooth paste. I took photos, copy of receipt & product back to them. Mailed it to them. A few weeks past. They sent a nice letter. & free couponds for 3 more of the same product.

You haven't mentioned any damages, so any lawsuit would be thrown out.

Did you have doctor's bills, for example?

Sue for what? What damages did you incur?

Why would you worry about suing?

Just take it back to Walgreens.

Take it back to the store with the receipt.

Assuming this it true, you could sue Colgate, or whoever makes Colgate brand products.

You have ZERO case against Walgreens.

Note: Maggots wouldn't SURVIVE anywhere near long enough to be found in expired toothpaste.

You can sue, but winning would be difficult because the expiration date was not hidden from you before you made the purchase and other than the value of the purchase price, you were not damaged. Return the tube to walgreens with your receipt and get your money back.

Yes, you can sue. Unless there were some other damages, you will be awarded the cost of the toothpaste. Or, you could save a couple hundred dollars in court costs and just return it to the store.

Massive lawsuits are rare and usually involve some mitigating circumstance.
