    The case may proceed with circumstantial evidence. There may be twenty people who witnessed the assault.

    Lack of evidence usually results in no trial. District Attorneys aren't motivated to prosecute cases with slim to no evidence.

    That would depend greatly on what other evidence and testimony there is, what there is in police and medical reports, and what the criminal record of the defendant is.
