As an ebay buyer what do I do about unpaid item case?
I made a best offer on eBay and the seller accepted, then I had an unexpected expanse in my life. So now I have to wait a couple weeks to pay for my item. So i notified the seller about this twice. Then 2 days later the seller opens an unpaid item case even though i told him twice that i would need longer to pay for my item. As the buyer what can i do to avoid a permanent record on my account? I can't cancel my purchase because best offer puts me under a binding contract that requires me to buy them item. I still want to buy the item but just can't for possibly a couple weeks.

The case is valid. When you placed the bid, you entered a legally binding contract to pay the amount bid at the end of the auction if your bid won. The unexpected expense is your problem, not the seller's problem.
By your, logic, you should be able to tell a restaurant you can't pay for the food you just ate because your house caught on fire while you were eating. YES, that is the same argument.

The seller is NOT legally obligated to wait for their money because you have a problem that doesn't concern them. You entered into a binding contract. You did not fulfill your requirement to pay and they have asked eBay to release them from the contract so they can have their final value fee refunded and they can seek a new buyer. It is eBay that decides to place a mark against your account, not the seller.
You can borrow the money from somewhere else and fulfill the contract now, or the sale will be canceled and eBay will issue a strike against you - if they decide to. It's totally up to them.
