You want legal advice? Okay, but my first advice is that you STOP posting and reposting this same question, and your anger is unnecessary. YOU are the one asking the question, and if YOU don’t like the answer, stop asking the question.

No one but the attorneys involved and the Judge know if the Motion to Dismiss will be granted. One of those attorneys, by the way, was retained to represent YOU, and that attorney is more knowledgeable about the case than strangers on Yahoo. Does your attorney know you are asking this question on a public forum?

It will come down to which party is more believable - you or the driver or possibly the passenger. For that matter, I fail to see how what the driver said or didn’t say or knew or didn’t know matters. HE was the owner of the car. HE is at least partially liable. It’s just that simple.
