  • Writing legal demands in Texas without being an attorney? ?

    I handle most of my own legal matters involving TCPA, FDCPA, FCRA and ECOA violations by either creditors or debt collectors respectively. And annoying telemarketer or debt collector calls. I write my own demands and usually end up with  a settlement. In one case I dealt with an employer I had who didn't pay me the wages they owed, that was my only employment law issue I have handled. I am not an attorney, but do cite the laws that I believe were violated in the demands that I do send. My question is, if I am not an attorney and someone in my family or a friends wants me to write a demand for them, which would be signed and mailed by them would I be committing a crime in writing the demand for them? Or would it only be illegal if I accepted money for doing so? I am not expecting to be paid anything by friends or family that I help with their issues, if I am able to help them. Most of the time I end up getting an email once a company I send demand to receives it and they settle, usually pretty quickly.

  • Has there ever been a disease a man could have which would reflect a negative result in paternity testing?

    I’m just wondering if anything like hidradenitis suppurativa could affect a DNA test resulting in the man being told that he isn’t the father when he in fact could be? I’ve done a lot of research of diseases before asking but couldn’t find anything really. Most google searches just pull up information about obtaining a DNA test.

  • My girlfriend of 4 years recently left saying no chance of reconciliation but now says she needs time to think, 1-2 weeks?

    My long-time girlfriend and I have a son together. The son may not be mine, but I do not care. He does look a lot like me, but one of those knock off at home DNA tests says he isn't mine. Anyway, when we would fight about something and I would get really mad I would call her ugly names, and she felt like I didn't spend enough time with her and our son. She has even made it out when I say that I want to be apart of his life, like I haven't been apart of his life at all despite providing for them and making sure he had everything he needs. She says that she needs time to think. I just stopped yesterday with calling, texting and driving by the house where she is staying (at her moms). She has kept all the flowers, cards and letters that I send. She said right now (saw her yesterday when I stopped by trying to see my son) that right now she is thinking she doesn't want to try and she finds it hard to believe that I am changing my ways when I won't respect her wishes and not contact her and let her think. I do know she still loves me and cares, otherwise she would not keep the cards, flowers and letters I have sent. I know there is no other man, she isn't like that. When she got pregnant was when we first met, and our sons due date was exactly 9 months on the button from the night we slept together. But we both had been told by doctors that we could not have kids. Sound like she will be back? I have faith and believe she will be.

  • Lexisnexis insurance reporting and fair credit reporting act?

    Is the reporting service which lexisnexis offers to insurance companies to assess risk based on crash data from insurance companies who submit reports about your accident history regulated by the FCRA? An insurance company reported an accident which I was not at fault for, but the insurance company left the fault indicator blank, leaving insurance companies to assume that I must have been at fault. Is there anything I can do to get that corrected under the FCRA?

  • Insurance cancellation what remedy is available in Texas?

    On January 31st, 2016 I began auto insurance coverage with Nationwide. I indicated that only my wife and I, of the drivers in our household at the time operate our vehicles. My policy premium was paid, and I was issued my ID cards all online. On March 11th, I receive an email from someone at Nationwide saying that I need to either have the other household drivers rated, or excluded. I could not simply exclude them, either apparently. They wanted specific reasons why I would exclude them and not have them rated and added to my policy. I replied to the email saying exclude them both and never got anything back. They cancelled our insurance, after the 60 days of initial coverage, for what they call failure to disclose someone as a driver, who was named on original application as not a driver.

  • Texas FUTA tax?

    What can be done about an employer who is deducting FUTA tax from employees pay and "adding" (aka hiding) it in the employees federal withholding taxes? Payroll lady told me I am taxed that tax and it's calculated into my federal withholding. I know that FUTA is not tax that employees are supposed to pay.

    If I get paid $18 an hour, with time and a half after 40 hours for overtime pay, my gross pay check is 774.00, with 40 hours at $18 an hour and 2 hours at $27 an hour. I live in Texas and don't have state tax, how much would my check be after my income tax, and social security and Medicare came out of my check?

  • Original Creditor reporting a charge off on a monthly basis, for over 3 years?

    I know, that creditors will report a charge off if you don't pay it off and all of that. But I thought that a charge off is a one-time occurrence? This creditor has reported "CO" every month for over 3 years now. I have never seen anybody else report an item on a credit report this way. Not even past creditors who have placed charge offs on my credit reports reported them monthly as a charge off. Wouldn't this actually make it seem as though they are charging off the balance owed each and every month, when in fact they are not?

  • B-52 AT-100 Half Stack Amplifier?

    I have a half stack that I bought a while back from a guy on craigslist. He showed it worked to me, by playing it when I went to pick it up. I noticed though after I got home and play it for a few minutes the volume just gets cut down to almost nothing where I can hear crackling and static and barely hear the guitar. I then have to crank the amp volume all the way up almost, then just hit the strings on the guitar and then the volume kicks back in. What could cause this? It happens in all three rectifier modes, meaning I can switch the mode when the volume cuts down like that, and switching the rectifier to either of the other modes doesn't make it come back. I just have to crank the volume up and scare the bejesus out of myself and anyone within a football field for the sound to come back like it's suppose to be. Any help?

  • CDL hours of service question....?

    I work for a company that does heavy haul locally, regional, and out of State. We are based in Texas. My question is about the new 34 hour reset rules being that only one reset can be taken in a 168 hour period. So, if we usually get off Friday evening, then by Sunday morning at 5a.m. we have our reset in and our 70 hour clock reset, though none of us rarely ever hit the 70 in a "typical" week. Now, if we worked through the weekend, even if we don't hit our 70 hours, the 168 hour period ended Sunday as usual, but we were working. So now we are taking our reset say on Monday or Tuesday, wouldn't that 168 hour clock begin at the beginning of the 34 hour reset, meaning that come Friday when we get off and were off all weekend we didn't get our 34 hour reset in because of the fact that the 168 hour clock started on Monday or Tuesday, whichever day it was that we got off? Ultimately meaning we have to work our way back around to Friday being the start of that 168 hour clock and just deal with taking our resets mid week instead of on the weekends like we "typically" have? I am correct, right? I know back before the new rules last year it didn't matter how many 34 hour resets you took as long as you took it when you needed to. Now with this 168 hour junk its confusing. Just need to know if I am right.

  • DVC Memphis PR 12's able to get 2 ohms?

    I have two Memphis PR 12 DVC subs, and a PPI Sedona 1300.1D amp. I know the amp is 2 ohm stable, but my subs are rated at 250wRMS, 500wPEAK, and I want to know if I should keep it wired in series at 520W RMS (assume that means its 260w per sub, right?)

    Would it be stupid to wire these subs parallel at 2ohms on the amp? Can it even be done without blowing the amp?

    If I did wire it parallel at 2 ohms, that would be pushing 900w RMS, which would be 350W per sub, correct? Would it blow the subs, or would it handle it since its peak for each sub is 500w?

    Sorry if I sound dumb, I went and bought all this crap and had it professionally installed but the bass seems weak really unless I crank it up way loud.
