My sister has to attend a 302 hearing tomorrow morning about her bf.....?

she has had a 'stalker' for several months, turned out to be him, i suspected that all along but it was some crazy stuff, even went so far as to stab himself claiming the stalker did it, threatened her kids, broke windshields, tampered with brake lines, i'll kill you all messages and several other 'suspects' being pulled in questioned and accused by police. My question is....how should she handle it, how can she 'encourage' them to keep him longer, this guy obviously has serious issues and she is scared of what will happen when he gets out. He has been there since Saturday night, she found out he was the source of the messages and the police put him in. However, stalking is just a misdemeanor so even if they do bother to do the paperwork (which they probably won't in this town) it won't have anything much in the way of repercussions. any suggestion or information on these hearings would be greatly appreciated! thanks in advance for your help!

    There are a few things she can do, but unless he does something more illegal than stalking her, her options are few. She can put a restraining order on him, but that doesn't stop him from doing something before he gets caught. She can make sure she always has someone with her, so that she has protection and a witness. She can move to another town or state. She might be able to hide out in a woman's shelter, along with her kids. She could hire a bodyguard. There might be more things that she can do, according to the laws of her state. Maybe talk to a lawyer to see what her other options are. If it were me (and this is totally what I would do), I would make sure my gun was loaded and my baseball bat close at hand. My insurance agent once told me that if someone was breaking into my house to make sure that I hit what I was aiming at and drag the body into the house, then call the cops. That saves the taxpayer many thousands of dollars in court, lawyer and jail costs. And he won't bother anyone ever again. Of course, that's just one person's opinion. What your sister's options are may be a little less drastic than that. I hope all works out with a minimum of stress for her & her kids' sake. <*)))><

    In addition to the other suggestions I feel that she is going to need some type of paperwork that is court ordered for him to stay away from her and her property. She'll need to keep this with her at all times. If he goes there again, then she'll just need to continue to call the cops, and eventually the misdemeanors that build up should turn into a felony,charge.

    If she has the money, I would also recommend a car alarm system, with a house alarm. Have the police make regular passes around her house, and get a dog for the inside. The dog will bark if someone is around the outside. Best of luck

    She can get a permanent restraining order put against him. This will keep him away from her job, her house, her car, and the children. If things get too bad she may have to consider relocating. The police can assist her in this situation meaning she will have to change her indentity and everything. It is sad, but it sounds to me she is dealing with a psycho and I pray that he doesn't harm her. Pray for your sister every night.

    The first thing you should do is speak to the DA (district attorney)....once he started tampering with your brakes he's beyond stalking....that's more like attempted murder...they will look at any evidence they have against him and see what they can charge him with.....the judge will most likely order a psycho evaluation on him first to see if he is fit to stand trail....he sounds like a real nut job.....

    Get a restraining order against him and if possible move and dont give the new address to that person or friends of that person.

    Insist that the D.A. file all charges possible. get a restraining order. and teach her to use a firearm.

    Stalking might only be a misdemenor, but I think death threats are more serious.
