How can you find out if someone has had their name expunged?

My ex is a criminal and has contact with our children. I did a criminal check on him to see if anything recent has occurred and nothing came up....I know he's been convicted of an A and B misdemeanor in the past and God knows what has happened since our divorce. But the criminal record says he's squeaky clean!! Please help, I have young children.

Update:

My children deserve a father who treats them right. He emotionally abused them. He has earned the right to see them after several years of supervised visitation. So, Mr. C. any other self-rightous comments??????The boys now have a step-father who treats them with love and respectful discipline.

Update 2:

Lastly, the misdemeanors were for physical abuse and threatening to kill the children.

Update 3:

They don't just hand out court orders of protection....you need proof of a serious threat not just "fear"....I know I've had several restraining orders and many of them were OBO (on behalf of children)....I walk a fine line of protecting my kids and not overprotecting them from their sperm donor....that's all he is. He's been in jail....he's a sociopath....and a criminal....those are the facts.

the 1st 2 answers are pretty good. if that doesn't help, see what the courts can help you iwth. If you need to sue him again for child support, or maybe change up the visitation so the court rechecks his history. after that your lawyer should be able to request a copy of all paperwork involved, to include his criminal history

It's probably not expunged. He probably did counseling or underwent court-ordered rehabilitation so it wasn't put on his record.

Forgive me, but I really feel badly for your children right now, and its not because this man has "misdemeanor" mistakes in his past. Sorry but you are being WAY TO VAGUE for me to believe you are being at all reasonable.

Don't hold the chains of misery for your family!

Seriously Ma'am I am looking at your past questions... I'm wondering why you don't get a restraining order if you are actually afraid of something?

Again, I apologize but I see a very disturbing pattern in your snooping around. You don't need to do that if there's anything to fear, anyone who knows anything about the law knows you can get a restraining order in the state of New York where you live.

To refer to him as a "Criminal" is slander and makes you a criminal too. The difference is I actually can see proof of your offenses and you are telling me nothing that supports your claim about him. That is the dictionary definition of slander, Ma'am.

Get your act together! If you do get that restraining order, don't slander in court. It'll backfire on you... just tell them you are afraid, and they'll grant it to you unless he shows a reasonable defense.

I'm sorry to tell you this, but if his name is expunged, you don't have a right to that information. Also, at least in Michigan, criminal reports don't include misdemeanors and you would have to do a Freedom of Information Act request to the court that he was involved with. Good luck to you and your children.

Question is, when did he commit the offences? was he charged as a juvenile or adult ? Under juvenile, his record is sealed, even to law enforcement and the courts. OR he received a Conditional Discharge when sentenced by the judge which means ''be good and after you finish your probation period, you will have no record''.
