Dog legal advice needed?

I live in the UK and have a long term assured tenancy. I have a huge wooded back garden where I keep chickens. At the bottom of my garden is a wire boundary fence, then about 10 metres of woods and then a public footpath.

I have a few laying hens in an enclosed pen. A woman who walks her dogs allows her terrier to come under our wire fence and hassle my chickens.

When I asked her to stop the dog doing this, she said that its a dog and can go where it likes and I should make my wire fence dog proof if I didn't want them in.

I rang the local Police who also said the same thing, I cannot believe that her dog is allowed to run free in my garden and that I am powerless to do anything about it.

We do have an airgun, which we keep the squirrels down with. Can I shoot over the dogs head to scare it off or I am going to be in the wrong? She is rude, obnoxious and not open to reason.

In a legal sense do I have any options open to me?

    I would double check the rules locally, surely they have leash laws and for instance if this was a farm then the dog worrying your stock would be open to being shot with out any issue from the police.

    I would go IN to the police station and get them to put their opinion in writing that this dog can do it...........think you MIGHT find that they have something else to say at that point.
