Can I collect unemployment?
I was let go from my job of 4 years on June 23, 2011 and was able to interview and get a new job starting July 18 2011. I worked the new job 8 days an realized it was not for me. I resigned on good terms since the company realized I was over qualified for the job.
I never filed for unemployment and want to no if I can do it now. Also I worked in NYC but live in NJ which state would I file in if I can?
Thank you for your help!!

You file for unemployment in the state that you worked, not the state that you live.
The only way to know for sure is to just file and wait to hear back from the state. They will let you know if you qualify for unemployment or not. And, if not, will most likely tell you why.

Depending on what state you are in, you can collect depending on why you were fired. If you are fired without being given warning and/or reason, you can collect. You can also quit and collect in certain circumstances but it is very difficult. Typically it is just if your company is going about things illegally/illegitimately or you are in an unsafe or threatening environment. This happened to me and it is very difficult to collect because I had all of the above and surprise, they lied to get out of the situation. But it can be appealed. I got letters of reference from coworkers who were willing to speak out or left the company, previous employers, character references, etc. I also had documentation of things that happened at the company. The only reason I didn't go through with the appeal was that I had a family member working at the same company who I was sure would be retaliated against (and was). Depending on your reasoning for needing to get out, call you employment security/unemployment office and contact a senator.

Really? You quit a job because you were over qualified and now you want to suck on the government teat?
If you needed money, you shouldn't have resigned the new position.

If youre overqualified, and your not happy just to HAVEa job in this type of economy, then leave. and dont put america into any more debt

You can still file for unemployment against the employer of 4 years. Whether you'll be approved may well depend on why you were let go. I don't know whether you should file in NJ or NY. I'd guess NJ. The NJ unemployment office should certainly be able to tell you that.

You quit your last employment. At best there will be a 8 week waiting period before you can get benefits.
