Regarding a legal will. is the inheritance issued AFTER the decease's outstanding debts are paid?

Two people are named to inherit from a will. One person got power of attorney to pay bills during the father's few recent hospitalizations. The person is now back at home but this person continues to keep the checkbook and is using those monies and the father's credit cards for their own use. Something tells me they are getting their inheritance up front. If the father passes away with a bunch of credit card debt, how will that be handled?

    The estate settles the deceased debts first.

    Any money gets paid to the bills first, whatever is left goes to the heirs.

    There are a lot of inheritance taxes. It's generally better to give things away before you die.
