Why isn't adultery considered a sex crime in the USA?

Update 2:

One could jeopardize the other partner with an STD by committing adultery. There was a time when the USA would not allow persons with AIDs to enter the USA and they also did not like people with that particular STD to spread it. How many spouses/partners are not being honest with their partner by not stating that they could be spreading an STD?

    Why is marriage allowed? No one can guarantee forever.

    Well that's not entirely accurate. Last I checked it could still get you court martialed from the armed forces but anyhow, if both parties consent to the sex had and they're full grown adults then the US government doesn't consider it a crime. Adultery is sin and I do not advocate it but that's the way things are.

    Adultery is a consenting sexual relationship between adults. Such relationships are not criminal. Adultery is a religious crime, a sin, it is not a secular crime. The USA is constrained by the First Amendment and cannot impose religion on the people therefore it cannot treat sins as crimes unless they also break the law and adultery doesn't.

    In the US it is a violation of the right to privacy to outlaw sex between two consenting adults.
