Can an employer intentionally wait 3 months before telling there employees that they have been layed off even if they were closed?

If the employees had stopped going to work and understood they would not be paid until they went back to work there is not much of a case.

If they are closed, you are clearly laid off. They don't need to explicitly say it.

Yes. There are very few laws in the U.S. protecting workers' right. If you want more laws, vote for Democrats. If you want the rich employers to have all the rights, vote for Republicans. 

Sure they can. We’re you getting paid during those 3 months. If you were then you have nothing to complain about. If you weren’t paid during those 3 months, you should have asked to be furloughed or laid off so you can start unemployment.
