Disabled parking problem?

My daughter is disabled and her twin brother is not but he needs to be dropped off at preschool first (different schools). Its a small private school and there is only 1 handicap parking space in the lot. I am having an issue with people without placards parking there or in the paint lined space next to it to drop off their kids which leaves me to struggle to get my daughter out of the car with very little room. I asked the school to put a note on the memo board about it but 2 weeks later there is no note and it is still happening. It is different people/cars each time so putting notes on cars would be difficult. Does the school have a legal responsibility to enforce the laws within their parking lot? If I have to I will call the police to enforce it but would rather try to be diplomatic about it first.

Pat...great idea that I would try if the parking lot was not so small! If I park behind the offender another person behind me would get blocked in also. Too bad!

    First, 'putting a note on the memo board' is weak...of course somebody is just going to pull it down. Your daughter comes first, stand up for her and you...you can still be diplomatic about it, but you need to address it to the school administration in person, not a phone call or note.

    I'm not sure, but I don't believe they have a 'legal' enforcement responsibility...but they can watch and see who is parking illegally and try to curb it. I think you've been very patient...so if it happens after you address it to the school, next time just park behind the person and call the police. I think the fine for parking in a handicap spot is pretty hefty...so after one or two instances, they should get the hint.

    Personally, I think people who park in handicap spots without a need to, are simply ill-mannered scum with no thought for anyone else. They deserve to be fined. If I were you, I would have called the police at least on the second instance, if not the first.

    The school is probably only responsible for providing a parking space, not for enforcing it.

    I've never heard of a state where police can not enforce handicapped parking anywhere open to the public, but it appears there may be a few.

    Occupying, or even blocking access to a handicapped space is illegal, regardless of how long you are there.

    Call the police. If the do tell you they have no authority, call the school administrator. All it would take is for someone to stand there a few minutes for a couple of days, the problem will be solved.

    I can understand you wanting to be diplomatic, but keep in mind every single person parking there knows it is illegal, they just think they can get away with it.

    You can start by talking with the head of the school- If he/she simply cannot do anything about the parking spot... Go to the Board of education OR the city they may be able to "make" another close spot handicapped as well....

    Ask if a teacher or a teachers aid would mind it if they would meet you in the parking lot to assist you in getting your son into the building so you don't have to leave your daughter in the car unattended OR if you are a member of the PTA see if another parent that drops off her children will see that your son gets into the school properly.

    If you can't get any resolution then by all means if you see the handicapped spot is occupied by a non-handicapped person then call the police at the very least they will get a hefty ticket !

    Speaking from Kansas Laws the school would be responsible for enforcement of the parking in that spot. Our police will not enforce it as it is considered private property.

    My wife deals with similar issues. She has MD and often faces not being able to find a handicapped spot. I know this is not ethical but she has even gone as far as parking behind cars to block them in if they are not displaying a placard. Her thought is since they inconvenienced her, why not show them what it is like. Ethical? No... Funny? Yes.

    Handicapped parking spaces are enforceable by by-law officers. It is by every stretch of the imagination illegal to park in a handicapped space.

    I would bypass the school and call your local by-law enforcement agency and request that they come to the school a few morning and hand out some easy tickets.
