My mother in law and sister in law, home question?
My mother in law has 5 kids, she told all the kids that upon her death, the house would be left to all of them, and to divide up the money or see what ever is fit, or agreed upon for someone to live there.
My father in law died 12 years ago.
not until recently we found out the one sister was added to her mortgage/deed. Now what happens if her mother dies, will she be left with the house because her name is on it too? or is all 5 kids still have any rights to the home...All five kids are in the will and stated they all get shares in the home.
did the sister in law pull a fast one on the rest of the 4 kids?
thanks for your help...what i mean by kids I mean my mother in laws kids they are all in there 40's and 50's

I believe you need to discuss this with a lawyer. At this time, your sister-in-law owns one half of the house. That means that your mother-in-law can not give this away in her will, since it doesn't belong to her. If the will states that her half goes to each of her children, it also means that your sister-in-law gets a further piece of the property- she'll have one half plus one fifth.
Your mother-in-law may not realize that she can't give away the whole house. You might want to take her with you when you see a lawyer. But at this point she can not take back the half that does not belong to her. The best that she can do is leave that daughter out when she divides her half.
